Terms and Conditions

1. General
  • This is a legally binding contract between the Property Owner, Sarah Pattison of Waveney Cottages and a single person, the ‘Holidaymaker’. The Holidaymaker is also referred to as “you.” The Property Owner is also referred to as “we” and “us”.
  • The Holidaymaker is the lead booker and must be 18 or over at the time of booking. You are the person who signs the booking form, or, in the case of online booking, the person who makes the online payment. You are responsible for ensuring all members of the holiday party accept and adhere to these terms and conditions.
  • The Property referred to being either Fox Cottage, Wortham – Thatched Cottage, North Lopham or White House, Wortham. Confirmation of the property will be on your booking information so please check that you’re booking into the correct
    property. We reserve the right to accept or decline your booking entirely at our discretion. Your contract with us begins when we issue you with your booking confirmation and will be based on the terms and conditions set out below.
2. Bookings
  • Payment is divided into two amounts and should be made as follows:
  • A non-refundable booking deposit of 20% of the total cost or £200, whichever is the greater.
  • The final balance of the remainder of the full amount is due ten weeks before your arrival date.
  • You may make a provisional booking by phone or email; provided the date of the rental is more than ten weeks from the date of the rental and, once the dates have been agreed, these dates will be held for a maximum of seven days.
  • The booking deposit must be received within seven days of the phone or email
    confirmation; otherwise, the Property will be released on the calendar.
  • If the final balance is not received by the due date, the deposit will be forfeited and the Property may be re-let.
  • Failure to pay the booking deposit or final balance in full by the due dates will constitute a cancellation of the holiday by you.
  • Payment reminders will be routinely issued via email to the email address given on the booking form.
  • Bookings made less than ten weeks prior to the arrival date must be paid in full at the time of booking.
3. Cancellation (If you change or cancel your booking)
  • 3.1 *COVID-19 Cancellation*
    • If the accommodation, Fox Cottage, is required to be closed due to a local lockdown or national lockdown, or we decide not to open the accommodation; we would firstly look to move the booking dates to a time which suits you. If this is not possible then we will offer a full refund.
    • This refund guarantee does not cover local lockdowns in the areas from which you will be travelling. It does not cover you if you’re unable to travel owing to you, or any member of your party, falling ill with COVID-19, or requiring quarantine or selfisolation.
    • We shall only be liable to return the monies received (including the deposit). No further financial claims, compensation or consequential losses will be considered.
    • Where COVID-19 restrictions amount to government “guidance” rather than law” then the terms and conditions of the contract dealing with cancellation and refunds will apply.
    • We strongly advise you to take out travel insurance that includes
      cover for COVID-19 illness, quarantine and self-isolation.
  • 3.2 Changes
    • If you want to change any detail of your confirmed booking, we will do our best to make the changes. However, we must receive your notice in by email to sarah.pattison603@btinternet.com. We cannot guarantee that we will be able to meet your request. Changes can only be accepted in accordance with our terms and conditions. You may be asked to pay any costs incurred by us in facilitating this change for you, which will be charged at the current brochure, website or Facebook page price, which may be different from the price in the brochure or website from which you booked your chosen arrangements. We may treat changes to your dates or property as a cancellation of the original booking and so you will have to pay cancellation charges.
  • 3.3 Full cancellations
    • Once booked, you are liable for the complete Property rental costs. Your booking is for the entire property.
    • It is strongly recommended that you take out appropriate insurance
      to cover costs incurred by unexpected holiday cancellation.
    • If you have to, or want to, cancel your booking after it has been confirmed, you must email sarah.pattison603@btinternet.com or phone us on the number shown on your booking confirmation as soon as possible. The day we receive your notice in writing by email or through the post to cancel is the date on which we will cancel your booking. Depending on your reason for cancellation, you may receive a refund of all money you have paid to us for your booking. We will also charge a cancellation administration fee of £50 for each week or part of a week per booking.
    • If you have paid the balance of your total holiday cost and then have to, or want to, cancel, you may receive a refund of part of the cost. However, if you have not paid your total booking cost by the time of your cancellation, you may have to make a further payment to cover the cancellation charge.
    • For the purpose of the table below, total cost means the total cost of the
      accommodation booking, including any extra items. You will still have to pay any credit-card charges and administration fees for making any changes. If you have already paid credit-card charges and administration fees, we will not refund these if you cancel.

  • If you live outside the UK and have booked through a local agent, the term ‘total cost’ in the above cancellation charges table means the amount paid by your local agent to us after taking off any booking fees, insurance premiums and any administration charge paid to us for making any change. To avoid any doubt, total cost does not include any charges made by your local agent or anyone else for booking fees, flights other travel services or any other amounts not paid to us. Other service providers may charge higher cancellation charges.
  • On receiving your cancellation, we will release those dates again. Should we rebook those dates then we will refund you with the amount we receive, up to the amount you have paid. If the new booking was sold at a lower price, you will receive that lower amount. We are not required to sell the dates for the same price that you had paid.
  • 3.4 Cutting short your stay (UK only)
    • Once booked, you are liable for the complete Property rental costs.
      As such, it is strongly recommended that you take out appropriate
      insurance to cover costs incurred by unexpected holiday
      cancellation.
    • Part cancellations
      If only one or more persons in your party needs to cancel, this will not affect the total cost of your booking. You are booking the property as a whole. You are not paying per person. The cost of the stay would be the same for one person as it would for 6.
  • 3.5 Cancellation by the Property Owner
    • We will endeavour to make sure the Property is available for the dates contracted. In the unlikely event the Property becomes unavailable, and we have to cancel the booking, then we will endeavour to find you suitable alternative accommodation. If suitable alternative accommodation cannot be found, you shall be entitled to a full refund. We shall only be liable to return the monies received (including the deposit). No further financial claims, compensation or consequential losses will be considered.

  • 4. Availability
    • The booking is made on the understanding that the Property will be placed at your disposal on the dates agreed. Should this not be possible through fire, theft or circumstances beyond our control, the full amount paid by you will be refunded. However, note that no alternative accommodation will be provided; you will not have
      any claim against us for compensation, loss or expenses.
  • 5. Private Holiday Occupation
    • This Agreement shall not confer on us any security of tenure within the terms of the Housing Act 1988 pursuant to which the occupation shall be deemed to be by way of an excluded tenancy.
    • You shall not allow any person or persons to sleep in or otherwise occupy the Property except as specified on the booking form. If this is not observed, we reserve the right to refuse admittance or require that you vacate the Property. In this eventuality, no refund of monies is due.
    • The Property is booked strictly on the basis that it is used for private holiday accommodation only. There is no right to remain on the Property after expiration of the rental period.
  • 6. Nuisance, Annoyance and Unreasonable Behaviour
    • You must not use the Accommodation, or allow it to be used, for any dangerous, offensive, noisy, illegal or immoral activities. You shall not do, or allow to be done, anything which may become a nuisance or annoyance to the occupiers of the neighbouring properties. If this is observed, we reserve the right to refuse admittance or require that you vacate the Property. In this eventuality, no refund of monies is due.
    • We reserve the right to ask you and your party to leave the Property should your behaviour and/or your party be considered by the us to be unreasonable. In this eventuality, no refund of monies is due.
  • 7. Number of Guests
    • The maximum number of people entitled to stay at this Property is six (6) at Fox Cottage, eight (8) at Thatched Cottage and twelve (12) at White House, excluding infants under 12 months of age. Only those people named on the booking form are entitled to stay. If it is found that more people than agreed are using the Property, then this will be considered a breach of contract and you and your party will be asked to leave immediately. In this eventuality, no refund of monies is due.
    • Sub-letting or assignation of the let is prohibited.
  • 8. Pets
    • Up to two well behaved dogs are welcome at no extra charge on the conditions set out on our website. A copy of these conditions can also be found at the Property. You must inform us, at the time of booking, if you wish to bring a dog. All dog mess must be removed from the outside areas, bagged and placed in the general waste wheelie bin before check-out. We reserve the right to charge an extra cleaning fee if, by failing to stick to these requests, extra cleaning is required at the end of your stay.
    • By agreeing to these Terms and Conditions you are agreeing to the dog policy on our website. If the number of dogs is more than two, please confirm this with the Property Owner.
  • 9. Smoking and Naked Flames
    • Smoking is strictly prohibited within the Property. If smoking is observed on the premises, then a breach of contract will be deemed to have taken place and you and your party will be asked to leave immediately. In this eventuality, no refund of monies is due.

    • Vaping of e-cigarettes is also not permitted on the premises and will entail the same consequences.

    • You and your party must not use candles, fireworks or Chinese lanterns or any other item with a naked flame at your Accommodation. You must not light bonfires in the ground of or near to the Property.

    • WHITE HOUSE ONLY – You are permitted to use the wood burners situated in the sitting room and in the dining room. By agreeing to these Terms and Conditions you agree to read and adhere to the instructions which will be sent to you before your stay. This is for your own safety and that of the other guests. A copy of these instructions can also be found in your house information at White House.

  • 10 Hot Tub (White House and Thatched Cottage)
    • Use of the hot tub is offered as a luxury extra at the Property, on the basis that it is used for recreational use only. Access is not guaranteed, and we will not be liable for any form of compensation or expenses claimed by you in respect of the provision of the hot tub.
    • For your own safety and for the safety of other guests, a full list of hot tub instructions will be sent to you prior to your stay. A copy can also be found in the house information pack and also outside, by the hot tub. By agreeing to these Terms and Conditions you are agreeing to adhere to these rules and instructions.
    • The hot tub will be cleaned and refilled on each change over day. This means that at busy times the hot tub may not be at the required temperature until the evening or the first morning of your stay.
    • There may be occasions when an engineer is called to make repairs to the hot tub. On such occasions we will inform you of their arrival time. You will not need to be at the Property when any maintenance or repair work is carried out on the hot tub.
    • We reserve the right to close, drain and turn off the hot tub if we observe any abuse of the hot tub rules. Any damage resulting in abuse of the hot tub rules will be fully chargeable.
  • 11. Arrival and Departure Time
    • Every effort will be made to have the Property available from 4.00pm on the day of arrival.

    • Information about keys and how to collect them will be provided once full payment has been received.

    • The Property must be vacated by 10am on the day of departure. Late departure will result in an additional charge being made.
  • 12. Liability
    • We take no responsibility for your personal possessions or for those of your party.
      Vehicles and possessions are left entirely at your own risk.

  • 13. Safety
    • We take safety seriously and takes all reasonable steps to ensure that the Property is safe; however, your stay at the Property is entirely at your own risk. The Property Owner can take no responsibility whatsoever for any accident, injury or loss, howsoever caused, during your stay.
    • Children must be supervised at all times.
  • 14. Repairs
    • The Holidaymaker shall permit the Property Owner to enter the Property at any reasonable time of day to inspect the condition of the decorations for the purpose of carrying out repairs that may be required
  • 15. Breakages
    • You undertake to keep the Property and all furniture, fittings and fixtures in the same state of repair and condition as at the start of the holiday. We must be informed of any damage or breakage prior to departure. We retain the right to make an additional charge for damage and breakages.
    • Where an outside contractor is required to repair damage, a charge will be made and charges will be passed onto you directly. Should the damage result in (a) subsequent booking(s) being cancelled, you will be held liable for all consequential losses to the Property Owner.
    • However, it should be noted that minor breakages, such as wine glasses, and reasonable wear and tear will not be charged for. We would like to be made aware of these small breakages in order that we can replace items for subsequent guests.
  • 16. Service
    • Every endeavour is made to ensure that your stay at the Property is memorable, for all the right reasons. If you should encounter any problems during your stay, or if you are dissatisfied with the service you receive, you should refer to the Property Owner immediately. The Property Owner will take all reasonable steps to correct any problems arising. You can call Sarah on 07795806012 or Stuart on 07483889480.
    • The Property Owner will not consider claims for problems notified to them after the hire period has ended.
  • 17. Complaints Procedure
    • If you are not fully satisfied with the accommodation offered, you must immediately contact us, and every reasonable effort will be made to resolve the problem.
    • We will not consider claims for problems notified to them after the hire period has ended.
  • 18. Amenities
    • The use of the Property includes gas, electricity, water, heating, bed linen, towels, cleaning products, bathroom toiletries, and use of TV and Wi-Fi.

    • White towels are to stay at the Property.

    • If required, you must provide your own beach towels.

    • Bedding and towels will be chargeable if damage is caused due to unreasonable use. This would include towels used for floor cleaning or for drying dogs. It would also include make up, fake tan or sun cream on towels or bedding.

    • Wi-Fi access is offered at the Property, on the basis that it is used for recreational use only. Neither a minimum speed, unrestricted bandwidth nor uninterrupted provision of access is guaranteed, and we will not be liable for any form of compensation or expenses claimed by you in respect of the provision or quality of internet connectivity

  • 19. Parking
    • Parking is free of charge at all three Properties.
    • Fox Cottage – One car to be parked on the drive opposite the side door. One car to be parked at the back of the property.
    • Thatched Cottage – Parking for 3 cars on the gravel drive at the side of the house.
    • White House – Parking for 2 cars at the rear of the property and space on the road in front of the house if required.
    • You must ensure unobstructed access for other road users and emergency services.
  • 20. Cleaning
    • The Property and any equipment used, including utensils, must be left as found at the end of the hire period. A vacuum cleaner, mop and cleaning products are provided.
    • We retain the right to make an additional charge for cleaning if the property is not left as found.
    • You must take responsibility to ensure that all cleaning products are kept out of the reach of children.
  • 21. Left Items
    • You will be notified of any of your possessions that have been left at the Property after it has been vacated. You must meet the cost of any items to be returned to you.
  • 22. Security
    • You are responsible for the security of the Property for the duration of the booking period.
    • Upon departure, the Property must be fully secure. All windows, the door to the garden, and the front door must be closed and securely locked.
    • On the day of departure, the keys must be returned to the key lock box which should be secured, and the number combination returned to a position that locks the box.
  • 23. Variation to Description
    • Whilst every care is taken to provide a true and accurate description of the Property on the website, literature and advertising, over time, changes may be necessary. We reserve the right to make changes without notice. You accept that no refunds are available for such discrepancies.
